Health Care: Licensing and Regulatory

Retaining their license to practice is one of the most critical legal concerns of any licensed healthcare professional. Even a single unsubstantiated patient complaint can threaten their livelihood. At Adler, Cohen, Harvey, Wakeman and Guekguezian LLP, we have the experience and expertise to assist clients through even the most complex licensing issue.

We have represented hundreds of healthcare professionals, from physicians and nurses to dentists and chiropractors, before the various Massachusetts and Rhode Island state licensing boards. Our experience includes numerous cases with the Board of Registration in Medicine (BRM) and the Division of Administrative Law Appeals (DALA), as well as appeals to the state Supreme Judicial Court. In cases alleging discrimination, we represent clients before the Massachusetts Commission Against Discrimination (MCAD).

As evidence of our expertise, Adler, Cohen, Harvey, Wakeman and Guekguezian was chosen by the prestigious Massachusetts Medical Society to serve as sole counsel for its Legal Advisory Plan, providing its members with legal advice and representation on a range of licensing and administrative issues.

Our healthcare licensing and regulatory practice area includes:

Crisis Response—We represent healthcare professionals responding to complaints filed with licensing and regulatory boards. Our years of experience, frequent interactions with licensing board members and in-depth knowledge of board policies and procedures enable us to help clients respond effectively to curtail investigation and avoid discipline. Clients also benefit from our extensive medical malpractice experience. We have found that our early involvement in licensing board matters can help control the outcome of any related civil lawsuits that may arise.

License Application—We work with healthcare professionals from other jurisdictions in obtaining Massachusetts or Rhode Island licenses. We have particular expertise in representing professionals who have had complaints or other issues with licensing boards in other states or countries.

Risk Management—As one of the most experienced and respected firms in the area of medical malpractice and licensing, we share our knowledge to help healthcare professionals avoid licensing problems. In addition to lectures before professional organizations, we consult with clients on a wide range of risk management strategies, from office practices and informed consent to patient communications and patient complaints.
